Terms of Use

Service: Airfoil Engine Analysis (the "Service") Effective date: [EFFECTIVE DATE] Last updated: [DATE]

These Terms of Use ("Terms") are a binding agreement between you and [Company Legal Name] ("we," "us," or "our") governing your use of the Airfoil Engine Analysis website and application. By creating an account or using the Service — including the free upload tool — you agree to these Terms. If you do not agree, do not use the Service.

Important: Section 7 explains that the Service is an informational tool only and is not a substitute for a certified aircraft mechanic or for your own airworthiness judgment. Please read it.

1. The Service

The Service decodes engine-monitor data files that you upload, analyzes that data, and presents charts, summaries, trends, and comparisons. We may add, change, or remove features at any time.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate account information, to keep your password confidential, and to be responsible for all activity under your account. Notify us promptly of any unauthorized use. Accounts are for a single user and may not be shared.

3. Subscriptions, billing, and cancellation

4. Your content and uploads

You retain ownership of the engine data files and other content you upload ("Your Content"). You grant us a worldwide, non-exclusive license to host, store, process, decode, analyze, and display Your Content solely to operate and provide the Service to you.

You represent and warrant that you have the right to upload Your Content and that doing so does not violate any law or any third party's rights. Do not upload data for an aircraft you do not own or operate, or are not otherwise authorized to analyze.

As described in our Privacy Policy, we also create de-identified, aggregate statistical summaries from analyzed flights to produce comparison benchmarks. These summaries contain no information identifying you, your account, or your aircraft.

5. Acceptable use

You agree not to:

6. Intellectual property

The Service, including its software, design, text, and the JPI Engine Analyzer name and logo, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose while these Terms are in effect. The Service incorporates third-party open-source components, used under their respective licenses.

7. Disclaimers — informational tool only

Read this section carefully.

8. Limitation of liability

To the maximum extent permitted by law:

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or of any law or third-party right.

10. Third-party services

The Service relies on third parties such as Stripe (payments) and AWS (hosting). Your use of those services through the Service may be subject to their own terms, and we are not responsible for them.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 4–9 and 12) will survive.

12. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in [County], New York will have exclusive jurisdiction over any dispute not subject to other agreed dispute-resolution terms.

13. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date and, for material changes, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
